Description:
Procurement of an interferon-free preparation with the active ingredient sofosbuvir/velpatasvir/voxilaprevir (ATC code: J05AP56) for the treatment of Hepatitis-C within the framework of an accelerated negotiation procedure aimed at concluding a framework agreement. The Kbt. Section 85, subsection (2), point c) states that the contracting authority shall use the negotiated procedure may apply if the most favorable offer cannot be selected without prior negotiations due to specific circumstances related to the nature, complexity or legal and financial structure of the contract or the risks associated with them. 16/2012. (II. 16.) According to Section 4 (1) of Government Decree the Kbt. Circumstances according to Section 85 (2) point c) shall be considered as the risks associated with treatment with medication, in particular the changing number of patients in need of treatment or their urgent need for care, the unforeseeable causes of the medications and medical devices to be purchased due to the change in its distribution. In this case, there is an urgent need for patient care, which is required by the government decree and the Code of Civil Procedure. on the basis of its referenced provisions, it supports the legal title of the negotiated procedure and the accelerated nature of the procedure.
