Penalty for failure:
a.)Failure of an individual order: In case of failure of the execution of the given individual order for a reason falling within the scope of responsibility of the Winning Bidder, or if the Winning Bidder fails to fulfill the given order in another -- scope of responsibility ffor an extenuating reason - refuses, or the delay has reached the maximum period (10 calendar days, which in these cases is also considered a failure), the Winning Bidder is obliged to pay a failure penalty equal to 20% of the net consideration of the order affected by the failure. Bid request argumentmay assert other claims against the Supplier beyond the penalty (damage claims, additional costs).(b) Failure to deliver/commission the instrument(s): If the contract to be concluded partially fails, the Winning Bidder shall pay a failure penalty equal to 20% of the net consideration (net purchase price) of the instrument affected by the failure....
