Description:
The tenderer wishes to purchase a surgical motor unit package and a hand tool package during the public procurement procedure, as stated in the technical description provided in the documentation.
Tenderer 321/2015. (X.30.) Govt. decree states, based on § 46, paragraph (3), that if the intermediateA clear, i.e. a sufficiently precise and comprehensible, definition of the subject of the contract made it necessary, so the use of references and references to things of the make, origin, and type specified in the notice and in the documentation was made solely for the purpose of a precise and comprehensible definition of the subject of the contract.
Aj321/2015. (X.30.) In accordance with the rules of the Government Decree, it also accepts performance with an "equivalent" product.
Proving equivalence is the Bidder's obligation.
Reason of point II.1.6: Surgical motor systems and hand tools form a functional unit, oneneither part can be used without the other. Thus, in case of failure of any part, the other would not be applicable either.
According to our point of view, the provision of partial bidding would not result in wider competition. Furthermore, the prohibition of partial tendering is also necessary for economic reasons.
