It is concluded in connection with the procedureThe condition for the entry into force of this contract is that the Tenderer receives its support request for the procurement, or possibly finances it from its own resources, and informs the Winning Tenderer of this electronically or at the same time by registered mail.The contract does not enter into force if the Sponsor rejects the request for additional support in writing, or supports it only partially or with a reduced amount, or is unable to finance it from its own resources. The Kbt. According to § 53, paragraph (6), in the above case, the request for additional support will not be acceptedacceptance, or in an amount smaller than requested, must be considered as a circumstance that the contracting authority can refer to as a reason for its inability to conclude or fulfill the contract [Article 75 §, § 131. Paragraph (9)], and the contracting authority is entitled to conclude the support contractgy in a specified amount as a condition suspending the entry into force of the contract to be concluded as a result of the public procurement procedure.
